October 2026 Waste Compliance Review: Updating Documents after the Code

The Ecological and Environmental Code took effect on 15 August 2026. A document review should check current legal references, the applicable regime, real data and recipient arrangements—not simply change the year. This is a review dated 20 October 2026, not a new government filing notice.

What Changed in the Legal References?

Article 1242 sets the effective date and repeals the listed former laws, including the former solid waste pollution law. Newly written current guidance should not present a repealed law as the sole current basis. Historical matters require their own facts and applicable rules to be considered.

This review focuses on Article 532 for plans, ledgers and reporting, Article 534 for operating authorisation and Article 536 for transfers. Updating a legal citation does not establish that the actual procedure has been completed.

Who Should Review These Items?

For Shanghai generators updating plans, changing processes or recipients, and managers still using older templates. This page is not a final opinion on a historical case, a particular waste classification or a live licence status.

If a pollutant discharge permit is already held, include Article 532’s provision on the permitting regime in the review. Do not mechanically assume every business follows the same separate filing route.

Documents for This Review

  • Current plans, ledgers, contracts, reports and transfer records.
  • An inventory and status information for EIA, acceptance and existing discharge permit documents.
  • Process changes, actual generation, stock and destination information.
  • Current recipient licence information and known gaps.

Four Steps for a Document Review

  1. Check references: distinguish the current Code, applicable supporting rules and historical documents.
  2. Check data: compare plans, ledgers, contracts, stock and actual destinations.
  3. Check the route: confirm the business’s regime, local requirements and recipient authorisation.
  4. Check records: produce a gap list and retain confirmations and feedback. Document preparation is not approval.

Common Mistakes and the Adviser’s Boundary

Common mistakes include changing dates only, applying one deadline to every task, treating recycling registration as a waste operating licence, or treating a signed contract as interprovincial transfer approval. Resolve uncertainties through facts and official requirements, not invented data.

Does updating the legal name mean filing is complete?

No. Reference checks, preparation, actual submission, corrections and final status are separate stages with separate records.

Should all old documents be deleted?

No blanket deletion is appropriate. Historical documents and transfer records may still need to be retained. Distinguish historical records from new current guidance and check the applicable retention requirements.
